01 – Preamble
The present general terms and conditions of sale (the “General Terms and Conditions”) are concluded between MAUD SUPPLIES and any non-trading individual (“You”) wishing to make a purchase on the Internet Site.
The present General Conditions exclusively govern your relationship with MAUD SUPPLIES.
MAUD SUPPLIES reserves the right to modify the General Conditions at any time. They will then be applicable as soon as they are put on line.
02 – Products
The products governed by the present General Conditions are those which appear on the Internet site and which are indicated as being sold and dispatched by MAUD SUPPLIES (the “Products”). They are offered within the limits of available stocks and on pre-order.
The essential characteristics of the Products are described and presented with the greatest possible accuracy.
03 – Prices
The prices of the Products are indicated in Euros, all taxes included. They take into account the VAT and any reductions applicable on the day of the order.
The prices of the Products are exclusive of delivery costs (postage, packaging and preparation of the package according to the amounts in force). The amount of the delivery costs will be specified before the order is validated.
If one or more taxes or contributions, in particular environmental taxes, were to be created or modified, either upwards or downwards, this change could be reflected in the selling price of the Products on the Website and on the various sales media.
However, a price cannot be modified once your order has been validated. Nevertheless, in the event of a price error (price clearly derisory in relation to the real value of the Product), the validated order may be cancelled by MAUD SUPPLIES. This measure remains exceptional.
04 – Order
4.1 Prior identification
To place an order, you must identify yourself with your e-mail address or your customer number and your password. For any first order, You must create an account.
This procedure remains mandatory to place an order.
4.2 Registration and validation of the order
You have the possibility to place your order online:
-either from the online store;
Once your basket has been validated, you must choose the address and delivery method, and validate your means of payment, this last step formalizing the sales contract with MAUD SUPPLIES.
You also have the possibility of placing an order in a single step (“order in one click”), once your payment card has been pre-registered and the address and delivery method preselected. This single step formalizes the sales contract with MAUD SUPPLIES.
Any order constitutes acceptance of the prices and descriptions of the Products available for sale.
MAUD SUPPLIES will acknowledge receipt of your order as soon as it has been validated by sending you an e-mail.
In certain cases, notably for non-payment, incorrect address or any other problem related to your account, MAUD SUPPLIES reserves the right to block your order until the problem is resolved.
In case of unavailability of a Product ordered, you will be informed by email. The cancellation of the order of this Product and its possible reimbursement will then be carried out, the remainder of the order remaining firm and definitive.

05 – Methods of payment
You can pay your order :
– by credit card: Carte Bleue, e-carte bleue, Visa, Mastercard, American Express. Your account will then be debited immediately. In case of out of stock or unavailable products, the amount of these products will be refunded or will be the object of a credit note according to your decision.
– with your PAYPAL account. By choosing the payment via PayPal, You will be automatically directed on your PayPal account. Once the PayPal payment is validated, You can complete your order on the Website. In case of out of stock or unavailable Products, the amount of these Products will be refunded or will be the subject of a credit note according to your decision.
-With Apple Pay, available via IOS. In the event that the Products are sold out or unavailable, the amount of these Products will be reimbursed or will be the subject of a credit note according to your decision.
06 – Delivery
6.1. Delivery in continental France, Corsica and Monaco
6.1.1. For small available Products
The service times indicated below are not guaranteed during certain periods of high activity, such as sales periods, and for custom-made Products.
– For the collection of your order, the service is available at the “Point Relais Colis ®” (2 to 4 days from the validation of your order). For the collection of the Products, a valid identification document will be required. Otherwise, the Products ordered will not be delivered.
-Chronopost” (2 to 3 days from the validation of your order).
– Colissimo” (3 to 6 days from the validation of your order). Delivery is made by La Poste. Beyond that, you can opt for the delivery Relais Colis ® Home below.
-” Relais Colis ® Home “(5 to 15 days from the validation of your order). Your parcels are delivered in front of your delivery address (gate, foot of the building or most accessible place) indicated at the time of your order, by appointment. The carrier will call you the day before to set up a 2-hour delivery slot.
Custom-made products will only be delivered to the address you provided when you placed your order or to the address you provided when you created your customer account. (Continental France, Corsica and Monaco only), in 8 to 18 days from shipment.
Concerning the sendings to the countries of the European Union, please contact us in order to proceed to an estimate which will have to be accepted by the customer (you) to validate the order.
6.1.2. For bulky Products (indicated by a colored van)
– Home delivery
Home deliveries are made to any location, including upstairs.
However, deliveries above the second floor depend on elevator access. Indeed, if there is no elevator or if the dimensions of the elevator are unsuitable for the transport of the Products, the delivery can only be made through the stairwell (subject to the dimensions of the stairwell). Beyond that, the delivery to the floor will have to be made by the customer (you). MAUD SUPPLIES shall not be held responsible if the carrier refuses to deliver the package beyond the second floor.
Therefore, prior to placing your order, it is your responsibility to verify that the Products can be transported to your floor or inside your home, in particular by taking into consideration the size and volume of the doors, stairwell or elevator with regard to the size and volume specifications of the Products.
Consequently, if there are one or more constraints related to the premises or to the means of access to the delivery site, and in particular delivery without an elevator beyond the second floor or dimensions of the landing doors that are not adapted, delivery to the floor will have to be made by the customer (you).
MAUD SUPPLIES shall not be held responsible for the impossibility of delivering the Products to your floor or inside your home, in the absence of information on the need to use specific means of delivery. In such a case, You shall have the option of
– Ask the carrier to take back the Product in application of your right of retraction.
– Accept the delivery, which will only be made in front of your home or at the foot of your building.
For deliveries made by the carrier on the metropolitan islands (except Corsica), these take place at the pier of the maritime station on the continent. You are responsible for the transportation costs between the pier and your home. For the island of Oleron and the island of Ré, deliveries are made to the delivery address that you will have given us.
– Delivery in a “Relais Colis ® Max” point (only for Metropolitan France)
The Products can be made available free of charge in one of the 1,000 Relais Colis ® Max points.
For the collection of the order of Products, a valid identity document will be required, as well as, if necessary, the card used for payment. Otherwise, the Products ordered cannot be delivered to you. You must load the Products into your vehicle and transport them yourself.
The Product will only be available in the chosen Relais Colis ® Max point for fourteen (14) calendar days from its arrival.
6.2. Delivery in the DOM TOM
You are invited to contact us at contact@maudsupplies.com in order to establish an estimate prior to any order validation.
MAUD SUPPLIES reserves the right to cancel any orders that have been paid for and validated without prior contact.
07 – Return of Products
7.1. Exercise of the right of withdrawal
You have a right of withdrawal of fourteen (14) calendar days from the date of receipt or withdrawal of your order.
During this period, You may return undamaged Products without having to justify your reasons or pay any penalty. In case of damaged Products received, the procedure of article 7.3 will apply.
All Products can be returned, except those excluded by law in article L221-28 of the French Consumer Code, for example Products that have been personalized at your request.
The returned Products must be intact and complete and must not have been subject to prolonged use.
To exercise your right of withdrawal, you may contact us at contact@maudsupplies.com and make an unambiguous statement indicating your intention to return the Product to MAUD SUPPLIES, mentioning your surname, first name and order number.
MAUD SUPPLIES will acknowledge receipt of your retraction by e-mail.
You must then return the Products to MAUD SUPPLIES, at the latest within fourteen (14) days following your withdrawal, either
– by Post/Carrier to the following address MAUD SUPPLIES (MANAS) “l’infirmerie, 45460, Bouzy-la-Forêt” or MAUD SUPPLIES (LEVY), 2 rue Bernard et mazoyer, 93300 Aubervilliers. You are responsible for the cost of returning the Product via La Poste/ Transpoteur (except in the case of a Product that is defective upon receipt, or an error by MAUD SUPPLIES when sending the Product).
MAUD SUPPLIES undertakes to reimburse you in full upon receipt of the Product in its warehouses.
As an indication, it generally takes between three (3) and four (4) weeks for a return to MAUD SUPPLIES’ warehouses.
LA REDOUTE will reimburse you for the returned Products, subject to compliance with the above-mentioned conditions, as well as for the standard “outbound” delivery costs of the latter if You return your entire order. The “outbound” delivery charges with supplements are reimbursed within the limit of the standard delivery charges. It is specified that the “outbound” delivery charges will be refunded separately.
If You do not return the entire order and keep one or more Products ordered, the amount of the “outbound” delivery charges will not be reimbursed by LA REDOUTE.
The refund will be made via the payment method used for the returned order.
Thus, for example, if the order of Products was paid by :
– Carte Bleue, and your Carte Bleue is still valid, the refund will be made to the account attached to this Carte Bleue.
– Paypal, and the Paypal account is still active, the refund will be made on this Paypal account.
– Apple Pay, and the Apple Pay account is still active, the refund will be made to this Apple Pay account.
– vouchers or credit note (at least 80% of the payment), the refund will be made in vouchers or credit note. ( according to the choice of the customer (you)).
For any other means of payment or in case of failure or impossibility of the previous refunds, the refund will be made by check letter sent to the billing address.
7.2. Exchange
You also have the possibility to request an exchange, within thirty (14) days from the reception of the Product.
You may return the Product to be exchanged to MAUD SUPPLIES by post or in a Relais Colis ® point.
As a reminder, you are responsible for the return postage costs.
For the Products. The Product to be returned must be intact, complete, packaged and, if necessary, unplugged. The return of the Product may be done at the same time as the delivery of the new Product, subject to the organization of carriers and the availability of the Product.
7.3. Special case of a non-compliant Product
MAUD SUPPLIES advises you to check the Product at the time of delivery and, in the event that the Product delivered does not conform (error in the Product, defective, damaged or incomplete Product), to make written reservations to the carrier and/or MAUD SUPPLIES at the latest within three (3) days following the delivery.
In all cases, the provisions set forth in Article 8.1 on legal guarantees shall apply. Thus, the Product delivered that does not conform shall initially only be replaced or repaired. Nevertheless, if the new Product received does not suit you, you may exercise your right of withdrawal within the remaining period.
For Products reported as non-conforming within three (3) days of delivery, MAUD SUPPLIES shall nevertheless allow you to exercise your right of withdrawal and obtain a refund of the Product in application of the provisions of article 7.1, without going through repair or replacement, as provided for by the legal guarantee of conformity.
08 – Warranties
8.1. Legal Guarantees
All Products on sale on the Website are covered by the legal guarantee of conformity (Articles L217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), allowing you to return defective or non-compliant Products delivered.
You are informed that MAUD SUPPLIES, domiciled at “l’infirmerie, Bouzy-la-Forêt, 45460” is the guarantor of the conformity of the Products to the contract within the framework of these two legal guarantees.
You have a period of two years from the date of delivery of the Product to take action in application of the legal guarantee of conformity.
In this case, you will be able to choose between repairing or replacing the Product, subject to the cost conditions provided for in Article L217-9 of the French Consumer Code.
For contracts entered into as of March 18, 2016, You are exempt from providing proof of the existence of the Product’s lack of conformity during the twenty-four (24) months following the delivery of the Product. For contracts concluded previously, the defect is presumed for six (6) months.
You are reminded that the legal warranty of conformity applies independently of any commercial warranty that may be granted by the manufacturer or MAUD SUPPLIES.
Furthermore, you may decide to invoke the guarantee against hidden defects of the item sold in the sense of article 1641 of the Civil Code. In this case, You may choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
– Article L217-4 of the French Consumer Code: The seller delivers goods that conform to the contract and is responsible for any defects in conformity that exist at the time of delivery. He is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his charge by the contract or has been carried out under his responsibility.
– Article L217-5 of the French Consumer Code: The goods conform to the contract:
1. If it is suitable for the use usually expected of a similar good and, if necessary :
– If it corresponds to the description given by the seller and has the qualities that the latter has presented to the buyer in the form of a sample or model;
– if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling;
2. Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
– Article L217-12 of the Consumer Code: The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.
– Article L217-16 of the French Consumer Code: When the buyer asks the seller, during the course of the commercial warranty granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the duration of the warranty that remained to run. This period runs from the date of the buyer’s request for intervention or from the time the goods are made available for repair, if this is after the request for intervention.
– Article 1641 of the Civil Code: The seller is bound by the warranty for hidden defects of the thing sold which make it unfit for the purpose for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lesser price, if he had known about them.
– Article 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect.
8.2. Commercial warranties
8.2.1 Certain Products benefit from a free commercial guarantee granted by MAUD SUPPLIES, known as the “MAUD SUPPLIES Guarantee”, in addition to the legal guarantee, which can be accessed via Returns and Guarantees. This contract shall specify the content, the terms of implementation, the duration and the territorial scope of the commercial warranty granted. For information on the terms and conditions of the MAUD SUPPLIES warranties, please refer to the Returns and Warranties tab on the Internet Site.
t is reminded that the commercial guarantee does not deprive you of the provisions relating to the guarantee of hidden defects or the legal guarantee of conformity, as recalled in Article 8.1 of these General Conditions.
09 – Evidence
In all cases, the online provision of the credit card number and the final validation of the order shall be considered as proof of the completeness of the said order in accordance with Article 1366 of the French Civil Code and shall be considered as proof of the sums involved in the seizure of the Products appearing on the order form.
This validation is worth signature and express acceptance of all the operations carried out on the Website. The computerized registers, kept in the computer systems of MAUD SUPPLIES and its partners under reasonable security conditions, shall be considered as proof of communications, orders and payments made between you and MAUD SUPPLIES.
Order forms and invoices shall be archived on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with Article 1379 of the French Civil Code.
10 – Responsibilities
MAUD SUPPLIES shall have an obligation of result for all stages of the order taking process as well as for the stages subsequent to the conclusion of the contract.
Thus, MAUD SUPPLIES undertakes to describe the Products sold on the Internet Site as accurately as possible. On the other hand, MAUD SUPPLIES shall not be held liable in the event that the non-execution of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure as defined by French jurisprudence. Similarly, MAUD SUPPLIES shall not be held liable for any inconvenience or damage inherent to the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.
